Leak in above apartment

Just heard apartment flooded by leak in German owned apartment above, getting sorted, but apparently no insurance above! Surely rules of these communities should insist that owners have property insurance? Anyone else had similar experience?

Not 100% sure on this but my impression was Insurance is required by law.

I thought it was the responsibility for the property management company to have block insurance on the physical building, and the individual owners/renters to have a contents and public liability insurance ?
