Non residents tax

Help needed
Just arrived back from Fuerte to find I have 2 different letters (each 5 pages and can only understand bits) from Madrid relating to non-residents tax that has to be sorted with supporting documentation within 10 working days following day of receipt (today)
It mentions Model 210, Catastral references, valor catastral, 50%, 365 dias and base imponible and 57.04 euros on one letter 51.85 on the other.
Looks like I need specialist advice ??? and I might just have to pop back across for a few days to get it sorted  :) :).
My place is in Costa Calma, can anyone advise someone in CC or else-where on the island who specialises in filling in the relevant forms please.

PS My wife Pam hasn't had any letters yet but has a 50% share in the property, can she expect to receive the same?

We used www.spanishtaxforms.co.uk to do our return. All went smoothly, you can even have them pay the assessed tax for you for a small extra fee. Our solicitor wanted 150â,¬ to do it & not sure if that included actually paying the bill or just returning the forms. Spanish tax forms charged as far as I remember about £25 each plus £12 each for paying it. We had the same 50% ownership. HTH

Spanish Tax forms are really good. Have you paid this tax before? If not,maybe the correspondence is requesting some back payments? It may be worth your while telephoning them at Spanish Tax Forms and telling them about the letter from Madrid,it may be that if you send them a copy they can ascertain exactly your position.  It seems that the Spanish authorities are now hot on the case on claiming this tax which relates to owning a property as non resident and is a nominal tax for not renting it out to anyone else.  All the info is on the web site for STF as above.

Spanish tax forms as above are excellent I have used them for many years.  They work the tax out from the catastral value which you will find on your local tax invoice and email me the completed forms which I take to my bank here in Fuerteventura who then send the payment to Madrid. Spanish tax forms charge £25.00. I am a joint owner and we both have to complete forms and send separate payments. They have a good web site and are also very helpful on the phone. The tax in question is paid before end December for the previous year.

There is no rush you have a till the end of this year (December 31st)to pay for 2017, as you pay each year in arrears. If you have previous years to pay you can submit a form as well if you wish. As your wife is joint owner you will both submit a form but you pay half of the amount.

You can use the company that has been suggested by others or do it yourself.

I recommend you to go to this site with Internet explorer (IE) as it needs Java and sometimes as chrome doesn`t use java it can be a problem to load the page.

Important information to complete the form is ;
'Determination of the taxable base amount'
Box [04] Your valor catastral multiplied by 1,1% (2% if the last revaluation was prior to 1994)**
Box [21] 19.0% (See under heading Applicable tax rates below)
Box [22] The result of taking 19.0% of box 04
Box [23] Enter 0 or leave blank
Box [24] Same as 22
Box [25] Box [26] Box [27] Leave blank. This tax is not covered by the double taxation agreement.
Box [28] Same as 24
Box [29] Box [30] Enter 0 or leave blank
Box [31] Same as 28 (boxes 22, 24, 28 and 31 should show the same amount)
**This will change in respect of declarations made in 2016 for 2015 and the percentage will depend on when the most recent catastral revision was carried out (1,1% up to ten years ago and 2% more than ten years ago). More details to follow.

Please note that the amount to be entered in Box [04] is NOT the valor catastral but the result of applying the multiplier (1,1% or 2%). If there is more than one person named in the escritura a return is required from each person. The amount to be entered in box 4 is halved if there are two owners, divided by three if there are three and so on. So the formula to obtain the amount to be entered in Box 4 is:

valor catastral times 1,1% (or 2%) divided by two (or however many owners there are). This is 2% for La Oliva.

Hi Can the Man, do you mind if I ask, did you get your money paid into a Spanish Bank Account or a UK Bank Account? or other bank account but not Spanish?

Thanks Can, appreciated. I was thinking of closing my Spanish Bank account, still debating over it. Has anyone on here ever had a Spanish Tax refund paid into their English Bank Account? not holding my
breath for a YES answer.

Tamkid, I wish you well, I was over 3 1/2 years waiting for my refund of circa â,¬3,000. I submitted the claim via my solicitor within the prescribed time, but the Spanish revenue are a law on to themselves when it comes to giving refunds. Though they did pay me about â,¬12 in interest, big deal when I was down the spending power of 3K for over 3 years.  >:( >:( >:(

FYI, Your numbers don't add up!! Most likely it was your solicitor screwing up or holding onto your refund for a few years.

Interest is paid at the official rate of circa 4% per annum. If the claim was processed immediately (implied by the 12 euros), the money wouldn't take 3 years to get to your account. Sometimes its the third party that does the thieving, lol.

That's really interesting Calculator, I didn't realise that it gets paid into the Solicitors account or Accountants Account before it is transferred to their clients account. At the time of the sale of my property my solicitor completed all of the necessary forms in order to obtain a refund. I came away with the impression it would get paid direct into my account as my bank information is included in one of the forms.

As nothing has been paid into my account, someone on the forum recommended a Corralejo based Tax Accountant as a person that might get it sorted.

I contacted the recommended accountant to enquire on my behalf if he could find out the state of play regarding my refund direct to the Rosario Tax Office, he sent a few forms in Spanish (partly English) to sign and asked for a  Photostat of my passport sent, which I did. Do you think I have been extremely stupid and naïve???? as soon as I read your post I felt extremely stupid and naïve, I have a very uneasy feeling about the situation. I was thinking the forms were only to give permission for him to enquire on my behalf, I am now thinking I have probably given him the power of attorney.

I am going to the Rosario office in the near future, hopefully they will give me the low down on if it has been paid or not, and thank you for that info.

The more I research the subject the more I realise Calculator is right, its not looking good. The money is important but its the principle for me, they bang on and on about Tax Avoidance and the low life that fail to pay their taxes in Spain etc etc it seems to me the biggest criminals are the Spanish Tax Office and Solicitors.  European Community, don't make me laugh.
